Advertising Conditions
Advertising accepted for publication in the Darwin and Palmerston Sun is subject to the conditions set out in rate cards and rules applicable laid down from time to time by the Publisher.

Every advertisement is subject to the Publisher's approval and the Publisher may, at its discretion, refuse to accept an advertisement for publication if it believes the advertisement may infringe the rights of any person or may not comply with all laws and regulations of the States and Territories. The Publisher accepts no responsibility or liability in relation to any loss due to the failure of an advertisement to appear according to instructions.

The positioning or placing of an advertisement within the accepted classification is at the discretion of the Darwin and Palmerston Sun. Rates are based on the understanding that the monetary level ordered is used within the period of the order. Maximum period of any order is one year. Should an advertiser fail to use the total monetary level ordered the rate will be amended to coincide with the monetary amount used. The word "advertisement" will be used on copy which in the opinion of the Publisher, resembles editorial matter.

The exclusive rates quoted on rate cards or in agreements are exclusive of the Goods and Services Tax ("GST") that arise out of or in connection with the charges or agreement. Any monetary level orders entered into for advertisements, which are published after 30 June 2000 will be subject to GST. The customer agrees to pay any GST liability and an amount thereof shall be added to invoices raised against the customer.

The GST component does not count towards overall monetary order expenditure or rate card discount levels.

The above terms are subject to change, without notification, at the discretion of the Publisher.

Warranty & Indemnity
Advertiser's and/or advertising agencies upon and by lodging material with the Publisher for publication or authorising or approving of the publication of any material INDEMNIFY the Publisher, its directors, employees and agents against all claims, demands, proceedings, costs, expenses, damages, awards, judgements and any other liability whatsoever wholly or partially arising directly or indirectly in connection with the publication of the material, and without limiting the generality of the foregoing, indemnify each of them in relation of defamation, libel, slander of title, infringement of copyright, infringement of trade marks or names of publication title, unfair competition, breach of trade practices or fair trading legislations, violation of rights of privacy or confidential information or licenses or royalty rights or other intellectual property rights , AND WARRANT that the material complies with all relevant laws and regulations and that its publication will not give rise to any claims against or liabilities on the Publisher, its directors, employees or agents, and, without limiting the generality of the foregoing, that nothing therein is in breach of the Trade Practices Act 1974 or the Copyright Act 1968 or the Fair Trading Act 1987 or the defamation, consumer protection and sale of goods legislation of the States and Territories or infringes the right of any person.

Cancellations & Alterations
Advertisements cancelled after booking deadlines will be charged at 100%.

Advertisement Proofs
A proof is supplied for copy checking purposes only, not revision of content or layout style. One proof of each advertisement will be provided at no change, including corrections. Additional changes with proofs will be charged at $16.50 GST inclusive, per proof. Please check original proofs fully to avoid extra charges.

ALL COMPLAINTS MUST BE LODGED WITHIN 24 HOURS OF PUBLICATION

Conditions of Space Order Agreements & Multi-Week Buys
All agreements must be received by our office no later than 24 hrs prior to the day of commencement. Surcharge does apply where the agreement is not used. Maximum rebate allowance on agreements will be the next lowest figure on the rate card.

All agreements are set for a period of 12 months and are not protected where rate increases apply.

The Darwin Sun and The Palmerston Sun reserves the right to change classification, cancel, refuse, omit or alter publication date of any advertisements.

The Darwin Sun and The Palmerston Sun will not be responsible for the non appearance of any advertisement for whatever reason, however, every effort is made to comply with advertisers' instructions.

Clients are advised the Commonwealth Sex Discrimination Act 1984 makes it unlawful to discriminate on the basis of sex, marital status or pregnancy.

The Darwin Sun and The Palmerston Sun reserves the right to change or reject advertisements to comply with legal requirements or matters relating to good taste.
